What does “Formalities Chk Pass” mean and how long until examination?
Your paperwork (power of attorney, translations, user affidavit if any) cleared the Registry’s procedural check. Nothing is needed from you – the file now waits for an examiner. Examination reports currently issue within one to three months of filing.
My status says “Objected” – is my trademark rejected?
No. Objected only means the examiner has raised objections – usually under section 9 (descriptiveness) or section 11 (similar existing marks) – in an examination report. You get one month from receipt of the report to file a reasoned reply. Most objections are answerable; a rejection only happens after a reply and hearing fail.
What is the difference between “Accepted and Advertised” and “Advertised bef acc”?
Both mean your mark is published in the Trade Marks Journal and the 4-month opposition clock is running. “Advertised bef acc” (before acceptance) is used where the Registry publishes the mark before formally accepting it – typically applications claiming prior use. Practically, monitor for oppositions in both cases.
My application shows “Abandoned” – can I revive it?
Abandonment usually follows a missed reply or hearing. A review petition on Form TM-M under rule 119 can be filed within one month of the abandonment order if there was a genuine procedural lapse; otherwise the practical route is a fresh application. Act quickly – review timelines are short.
How long does trademark registration take in India in 2026?
A clean application with no objection or opposition typically completes in 8 to 18 months. An examination objection with a hearing adds one to two years (hearing queues run 6-18 months by office). An opposition adds two years or more.
