Single application with many classes, or separate applications?

The government fee is identical either way – it is charged PER CLASS in both routes, with no discount for a multi-class application. But the two routes behave very differently when something goes wrong: an objection or opposition against ONE class of a multi-class application stalls the ENTIRE application, and you cannot cleanly drop one class and let the rest proceed to registration. Most practitioners therefore file SEPARATE single-class applications for important brands, and reserve multi-class filings for uncontroversial cases where budget paperwork matters more.

Frequently asked questions

What is the government fee for trademark registration in India in 2026?
Rs 4,500 per class (e-filing) if the applicant is an individual, a DPIIT-recognised startup or a small enterprise with an Udyam certificate, and Rs 9,000 per class for companies and all other applicants. Physical filing costs Rs 5,000 and Rs 10,000 respectively. These First Schedule fees have not changed since March 2017.
Does a private limited company ever get the Rs 4,500 rate?
Yes – the discount is not about legal form but about status. A company qualifies if it is a DPIIT-recognised startup, or if it holds Udyam registration and its investment is within the medium-enterprise limit under the MSMED Act (from 1 April 2025: investment up to Rs 125 crore and turnover up to Rs 500 crore). The certificate must be uploaded with Form TM-A.
Is GST payable on trademark government fees?
No. Statutory fees paid to the Registry carry no GST. GST at 18 percent applies only on the professional charges of your attorney or agent, which is why this calculator applies GST to the professional component alone.
How much does the whole process cost if there is an objection?
Roughly 6 in 10 applications receive an examination report under sections 9 or 11. Replying involves no government fee, so the extra cost is professional – typically Rs 2,500 to 8,000 for a reasoned reply. If a show-cause hearing follows, add professional charges and Rs 2,700 (TM-M) per adjournment if any. Use the scenario checkboxes above to include these.
When does my trademark expire and what if I miss renewal?
Validity is 10 years from the APPLICATION date. You can renew from one year before expiry at Rs 9,000 per class. After expiry there is a 6-month grace with surcharge – Rs 13,500 per class in total. After the grace period, and up to one year from expiry, restoration plus renewal costs Rs 18,000 per class. Beyond that the mark is removed and a fresh application is the only route.
Is expedited processing worth Rs 20,000 or 40,000?
Expedited processing under Rule 34 fast-tracks examination – reports typically arrive within weeks instead of months. It does not skip the opposition window or shorten the journal advertisement stage. It suits businesses that need an examination outcome quickly, for funding, marketplaces or franchise deals.
