Delhi Shop & Establishment registration in brief

The Delhi Shops and Establishments Act, 1954 (with the Rules, 1954) regulates working hours, holidays, leave, wages and conditions of service for people employed in shops and commercial establishments in Delhi. Registration is compulsory for every shop, office, hotel, restaurant and establishment, and the certificate is routinely required by banks to open a current account and to support GST and trade registrations. Registration is done online through the Office of the Labour Commissioner, Delhi.

Who must register, and by when

Every occupier must file the statement in Form A within 90 days of the establishment commencing work, together with the fee prescribed in Schedule I. On being satisfied, the Chief Inspector registers the establishment and issues a registration certificate in Form C, which must be displayed at the premises. A schedule of exempted establishments applies to certain government, RBI and similar offices.

The fee is a low, fixed slab based on the number of employees, with a separate rate for larger hotels, restaurants and places of public amusement. The renewal fee is the same as the original registration fee.

Documents required

  • PAN of the business / proprietor.
  • Aadhaar or other identity proof of the employer / occupier.
  • Proof of the establishment’s address — electricity bill, rent agreement or ownership document.
  • Details of the establishment — name, category, nature of business and date of commencement.
  • Number of employees (men, women and young persons).
  • Constitution proof where applicable — Certificate of Incorporation (company) or Partnership Deed (firm).

Validity, renewal and change of details

Delhi registration is effectively long-term. Under Rule 5 the certificate is renewed at a long interval on payment of the same fee (Schedule I, column 4), with the renewal application in Form L filed within 30 days of expiry. Any change in the registered particulars must be notified in Form D within 15 days, with a nominal ₹3 fee.
