Frequently asked questions
Can one application cover my product AND my online store?
Yes – a multi-class application can cover, say, class 25 (clothing) and class 35 (retail/e-commerce). The government fee is per class either way (Rs 4,500 or Rs 9,000 by e-filing). Many practitioners still prefer separate single-class applications, because an objection against one class of a multi-class filing holds up all classes.
What happens if I file in the wrong class?
A trademark registered in the wrong class gives you no protection for what you actually sell, and the Registry does not allow shifting an application to a different class – you would have to file afresh. Competitors can also cite the wrong-class registration against you. Getting the class right at the start is far cheaper than fixing it later.
Should I file in all 45 classes to be safe?
Almost never. Fees are per class, and a registration can be attacked for non-use after five years in classes where you never traded. File in the classes you use or genuinely intend to use, and add closely-linked classes (like 35 for retail) where your business model needs them.
My product moved classes in the 2026 edition – which applies?
Applications filed from 1 January 2026 follow NCL 13-2026. A handful of goods shifted classes in this edition, so if you relied on an older guide, re-check the current class before filing. Marks already registered stay where they are.
